TOURIST LEASE (NON- BUSINESS - GENERAL TERMS & CONDITIONS

These General Terms & Conditions (“Terms”) govern the tourist lease of the property known as Villa Montecristo, located in Seccheto, Isola d’Elba (Italy) (hereinafter the “Property” or “Villa”), and regulate the contractual relationship between the owner/lessor and the lead guest (the “Guest” or “Tenant”) who makes the booking on their own behalf and on behalf of all individuals staying at the Property (“Guests/Occupants”).

By accessing www.villamontecristo.com, requesting information, making a booking, or staying at the Property, the Guest/Tenant confirms that they have read, understood and fully accepted these Terms.

1) LESSOR DETAILS

The Property is offered under a private tourist lease (non-business). This is not a hotel or hospitality business, and no hotel or para-hotel services are provided (such as continuous reception service, daily housekeeping as standard, or food and beverage service), unless expressly agreed and arranged separately.

2) SUBJECT OF THE LEASE

The lease concerns the temporary use of the fully furnished Property, including its equipment and amenities, for the agreed period (the “Lease Period”).

Unless otherwise agreed in writing, the lease includes the use of outdoor areas and the swimming pool (when available, subject to seasonality and maintenance requirements).

3) BOOKING AND FORMATION OF CONTRACT

A booking shall be considered validly confirmed only when:

  • the Lessor provides written confirmation (email or other traceable means); and

  • the Guest/Tenant pays the required amounts (deposit and/or balance) within the deadlines communicated.

The Lessor reserves the right to decline incomplete requests or requests incompatible with the nature of the Property (e.g., exceeding occupancy limits, unauthorised events, etc.).

4) RATES, PAYMENTS AND TAXES 

The rental fee (“Rental Fee”) is the amount stated in the quotation or booking confirmation. Any applicable local taxes or charges (e.g., tourist tax) shall be borne by the Guest/Tenant and collected in accordance with the applicable regulations.

 

5) SECURITY DEPOSIT

A refundable security deposit of € 500,00 is required and must be paid together with the balance of the Rental Fee.

The security deposit may be retained, in whole or in part, to cover:

  • damage to the Property, furnishings, equipment and systems;

  • breach of these Terms and/or the House Rules;

  • additional costs or extraordinary cleaning required to restore the Property.

The deposit will be refunded within a reasonable time after check-out, subject to standard inspections.

 

6) CHECK-IN AND CHECK-OUT

Check-in: between 5:00 pm and 7:30 pm
Check-out: by 9:00 am

Any different arrangements are only possible if agreed in writing and subject to operational constraints.

7) GUEST IDENTIFICATION AND LEGALE REQUIREMENTS

The Guest/Tenant undertakes to provide all required identification documents (ID for European citizens, Passport for non-EU citizens), including for all Occupants, in order to comply with Italian legal obligations, including guest registration with the competent authorities.

It is not permitted for any person not included in the booking to stay overnight at the Property.

8) MAXIMUM OCCUPANCY

The Guest/Tenant must comply with the maximum occupancy communicated at the time of booking and/or stated in the official description of the Villa.

If the authorised occupancy is exceeded:

  • the Lessor may require immediate compliance; and

  • in serious cases, may terminate the lease and require vacating the Property, without refund, without prejudice to any claim for additional damages.

9) HOUSE RULES

To preserve the Villa, ensure safety and respect the surrounding environment, the Guest/Tenant and all Occupants must comply with the following House Rules:

Waste disposal

  • Guests must follow the instructions and collection schedule issued by the local municipality for door-to-door waste collection and recycling.

Furniture and equipment

  • Furniture may not be moved or rearranged.

Smoking

  • Smoking is permitted outdoors only. Guests must use ashtrays and must not leave cigarette ends in the garden or common outdoor areas.

Security and alarm system

  • Whenever leaving the Property, Guests must close all windows and activate the alarm system.

  • Guests must ensure that all safety latches and locks, especially on gates and pool access points, are properly closed to prevent children from opening them unattended.

Barbecue

  • The barbecue must be used with maximum care to avoid accidents or fire hazards.

  • After use, it must be left clean.

Upon departure
Upon departure, Guests must:

  • return clean dishes, cutlery and kitchenware to their original place;

  • leave the hob, oven and barbecue clean;

  • leave used linen on the living room floor;

  • if traveling with dogs, remove any pet waste from the garden and all common areas of the Property.

Damage, missing items and additional charges
Any damage or missing items must be reported immediately to the Lessor or their representative.
The cost of repair and/or replacement will be deducted from the security deposit, as will any costs arising from non-compliance with the above rules (including, by way of example, extra cleaning, fines due to incorrect waste disposal, or restoration costs).

10) SWIMMING POOL AND OUTDOOR SAFETY 

The swimming pool and outdoor areas are features of the Property and require due care:

  • the pool must be used in accordance with standard safety rules;

  • children must be supervised at all times by a responsible adult;

  • unsuitable or hazardous objects must not be used in or around the pool.

The Lessor shall not be liable for accidents caused by negligence, misuse, or failure to follow safety rules.

 

11) MAINTENANCE AND ACCESS TO THE PROPERTY 

During the stay, access by maintenance staff (e.g., gardener, pool technician, repair technician) may be required for scheduled or urgent interventions.

Where reasonably possible, such access will be notified in advance and handled discreetly so as to minimise disturbance.

 

12) GUEST/TENANT RESPONSIBILITY

The Guest/Tenant is responsible for:

  • taking proper care of the Property and its equipment;

  • ensuring that all Occupants behave appropriately and comply with these Terms;

  • any damage caused intentionally or negligently, including damage to systems, furnishings, equipment, pool and outdoor areas;

  • loss of keys and any related security replacement costs.

Any malfunction or issue must be promptly reported to allow timely intervention.

 

13) LIMITATION OF LIABILITY 

The Lessor shall not be liable for:

  • interruptions or malfunctions of utilities/services (electricity, water, internet connectivity, etc.) not caused by wilful misconduct or gross negligence of the Lessor;

  • weather events, natural disasters, fire, government measures, or public works;

  • theft, loss or damage of personal belongings.

Nothing in these Terms excludes liability where such exclusion is not permitted by applicable law.

 

14) CANCELLATIONS AND CHANGES

Cancellation and change conditions are those stated in:

  • the booking confirmation and/or written agreement; and/or

  • the “Cancellation Policy” page on the website, where applicable.

If no specific written policy applies, any deposit paid may be retained as a confirmatory deposit (caparra confirmatoria) under Italian law.

 

15) FORCE MAJEURE

In case of unforeseeable and unavoidable events preventing the use of the Property (e.g., uninhabitability, natural disasters, authority restrictions), the Lessor may:

  • propose alternative dates; or

  • refund amounts received for the unused portion, excluding any duly documented costs already incurred.

 

16) PERSONAL FDATA (PRIVACY)

Personal data provided by the Guest/Tenant will be processed in accordance with Regulation (EU) 2016/679 (GDPR)and Italian law, solely for purposes related to:

  • booking and lease management;

  • legal obligations (guest registration);

  • contractual protection.

17) Governing law and jurisdiction. These Terms shall be governed by Italian law.

For any dispute:

  • if the Guest/Tenant qualifies as a consumer, the competent court shall be the court provided under mandatory consumer protection rules;

  • in all other cases, exclusive jurisdiction shall be the Court of Livorno (Italy).

18) VALIDITY AND UPDATES 

The Lessor may amend these Terms at any time. The version applicable to each stay is the one:

  • published on the website at the time of booking, or

  • sent to the Guest/Tenant at the time of confirmation.
